Terms of Use

1. Introduction

Welcome to Indigenous Energy Monitor (“IEM,” “we,” “us,” or “our”). These Terms of Use govern access to and use of our website, data tools, dashboards, databases, reports, and related content (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms of Use. If you do not agree, you may not access or use the Platform.

2. Acceptance of Terms

By accessing the Platform, purchasing a data license, or using any IEM products or services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use and our Privacy Policy.

3. Full Access Data Licenses

Indigenous Energy Monitor offers two categories of data licenses:
(a) Standard Data License, and
(b) Publisher License

All licenses are subject to payment of applicable annual fees.

3.1 License Grant (All License Types)

Subject to payment of applicable fees, Indigenous Energy Monitor grants the purchaser (“Licensee”) a non-exclusive, non-transferable, revocable, annual commercial license to access and use IEM’s premium databases, dashboards, and tools (“Licensed Data”).

The license applies solely to:

  • The individual or organization that purchased the license; and

  • Authorized employees or contractors acting on behalf of that organization.

No ownership rights are transferred. All Licensed Data remains the property of Indigenous Energy Monitor.

3.2 Standard Data License – Permitted Uses

Under the Standard Data License, Licensees may:

  • Access and analyze IEM premium data through dashboards and downloadable datasets;

  • Use the Licensed Data for internal:

    • research,

    • analysis,

    • planning,

    • reporting,

    • and decision-making;

The Standard Data License does not permit public publishing or distribution of charts, analysis, research, or reports derived from the Licensed Data.

3.3 Publisher License – Permitted Uses

Licensees who purchase the Publisher License may do everything described in 3.2 Standard License and also:

  • Publish aggregated insights, analysis, commentary, charts, or research outputs derived from the Licensed Data in:

    • public reports,

    • presentations,

    • blogs,

    • articles,

    • marketing materials,

    • or thought leadership content;

 

Provided that:

  • The underlying datasets and raw data are not disclosed, released, or redistributed; and

  • Proper attribution is clearly provided to Indigenous Energy Monitor.

3.4 Prohibited Uses (All License Types)

Unless expressly authorized in writing by Indigenous Energy Monitor, Licensees and Platform users may not:

  • Share, resell, sublicense, distribute, or otherwise make available any Licensed Data to third parties;

  • Provide external parties with access to IEM dashboards, datasets, or downloads;

  • Incorporate IEM data into third-party commercial products, subscription services, or resale offerings;

  • Scrape, crawl, copy, extract, or systematically reproduce the Platform or Licensed Data;

  • Use the Licensed Data to create competing databases, datasets, or services;

  • Attempt to reverse engineer, repackage, or replicate IEM’s proprietary databases or tools.

3.5 Requests for Expanded Commercial Use

Organizations wishing to:

  • Resell IEM data,

  • Embed IEM data in commercial products,

  • Create derivative databases,

  • Or use IEM data beyond the scope of the Standard or Publisher License

 

must obtain prior written consent from Indigenous Energy Monitor and enter into a separate commercial agreement.

4. Data Sources & Methodology

Indigenous Energy Monitor aggregates, standardizes, and analyzes thousands of publicly available and proprietary data sources to create its databases and tools. The organization applies independent judgment, classification frameworks, and analytical methodologies to produce value-added datasets and insights.

5. Disclaimer & Limitation of Liability

All data, analysis, research, and content provided by Indigenous Energy Monitor are supplied “as is” and for informational purposes only.

  • IEM does not guarantee the accuracy, completeness, timeliness, or reliability of the Platform;

  • The Platform may be incomplete, outdated, or subject to revision;

  • Platform users acknowledge that they rely on IEM data at their own risk and are responsible for conducting their own independent due diligence.

To the maximum extent permitted by law:

  • Indigenous Energy Monitor shall not be liable for any losses, damages, or claims arising from the use or reliance on the Platform;

  • Platform users waive any right to bring claims against IEM relating to data accuracy, omissions, or analytical conclusions. 

  • Indigenous Energy Monitor provides no gaurantee concering the data provided on our website and the data we sell and we cannot be held liable for the use of this data.

6. No Refund Policy

All fees paid to Indigenous Energy Monitor, including annual commercial data license fees and one-time access fees, are non-refundable, regardless of usage, outcomes, or termination.

7. Access Controls & Enforcement

Indigenous Energy Monitor reserves the right to:

  • Monitor usage for compliance with licensing terms;

  • Limit, suspend, or terminate access in cases of:

    • Excessive downloading;

    • Automated access or scraping;

    • License misuse or unauthorized redistribution;

    • Attempts to bypass technical or contractual controls.

8. Custom Research & Consulting Services

Platform users may separately engage Indigenous Energy Monitor for:

  • Custom research;

  • Data analysis;

  • Market intelligence;

  • Advisory or consulting services.

Such engagements are subject to separate scopes, pricing, and agreements and are billed independently from a data license agreement.

9. Third-Party Platforms

IEM delivers services using third-party platforms including Power BI (Microsoft), Wix, and Google Workspace. Use of these services is also subject to their respective terms and policies.

10. Termination

Indigenous Energy Monitor may terminate or restrict access immediately if these Terms are violated. Upon termination, all rights to use the Licensed Data cease.
